Fence installation – what is worth knowing before starting work?

Building a fence is an important step in the process of developing a plot.

A fence not only marks the boundaries of the property, but also ensures safety, privacy and aesthetics of the surroundings. However, before you start the assembly work, it is worth getting to know the construction law regulations governing the height, location and method of building a fence. This will help you avoid formal problems, such as the need for reconstruction, fines or demolition orders.

Legal basis for building a fence in Poland The basic legal act regarding the construction of fences is the Construction Law Act of 7 July 1994, together with its subsequent amendments.

A fence, as a building structure, must meet certain technical and location conditions. Key aspects, such as maximum height or the need to report the construction, depend on the specifics of the project.

For example, fences up to 2.2 m high do not require a notification.

However, if you plan to build a higher fence, you must report your intentions to the starosty or city office at least 21 days before starting the work. In some cases, e.g. near intersections, additional restrictions may apply due to road safety regulations.

General guidelines for fences

The regulations also specify the rules for building fences on the property boundary and on the street side. Important guidelines include:

Structure safety: Fence elements, such as sharp ends, must be at a height of at least 1.8 m.

Direction of opening of gates and wickets: They must not open outwards from the plot.

Minimum widths: Gate – 2.4 m, wicket – 0.9 m.

Location within the plot boundaries: The entire structure, including the foundation, must be located on your property.

Building a fence between neighbours

If you are planning a fence along the plot boundary, remember that civil law imposes an obligation on neighbours to cooperate. The costs of building and maintaining a shared fence can be shared, and it is worth writing down all arrangements in the form of an agreement.

Notification or permit?

If the planned fence exceeds 2.2 m in height or is located in specific locations, such as areas along public roads, it will be necessary to report or obtain a building permit. The report should include, among other things, information about the fence design and the work plan.

Compliance with building regulations allows you to avoid formal problems and ensures that the new fence will comply with applicable standards. To make sure that everything is done in accordance with the regulations, it is also worth familiarizing yourself with the local spatial development plan.
